These Terms of Use ("Terms") govern your access to and use of the website and services provided by Prolific AI Automation LLC ("Prolific", "we", "us", or "our"). By accessing our website or using our services, you agree to be bound by these Terms.

1. Services

Prolific AI Automation LLC provides AI-powered automation services for businesses, including but not limited to missed-call text-back systems, lead management automation, CRM integrations, and related workflow automation services. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

2. Eligibility

You must be at least 18 years of age and have the legal authority to enter into binding agreements on behalf of yourself or your business to use our services. By using our services, you represent that you meet these requirements.

3. Account and Access

Some services require you to provide credentials for third-party platforms (e.g., CRM systems, accounting software). You are solely responsible for maintaining the security of those credentials and for all activities that occur under your account. Notify us immediately at support@prolificautomation.ai if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose or in violation of applicable laws and regulations
• Send unsolicited communications in violation of the CAN-SPAM Act, TCPA, or other applicable laws
• Attempt to reverse engineer, decompile, or interfere with our systems
• Use our services to transmit malware, spam, or harmful content
• Misrepresent your identity or business when using our services

5. Messaging Terms (SMS and Calls)

Program. Prolific AI Automation LLC operates a customer care and account notification messaging program. If you provide your phone number and tick the consent box on our contact form, we may contact you by phone call and text message, including by automated means, about your inquiry, your audit, and the services you have asked us about.

Consent is not a condition of purchase. You do not have to agree to receive messages in order to request an audit, or to buy anything from us.

Message frequency. Message frequency varies and depends on your inquiry and the services you use.

Cost. Message and data rates may apply. Charges are billed by and payable to your mobile service provider.

Opting out. Reply STOP to any message to stop receiving them. You will receive one final message confirming that you have been unsubscribed. Reply HELP for help, or contact us at support@prolificautomation.ai or (810) 584-7103.

Carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile service provider and is not guaranteed.

Your data. We do not sell, rent, or share mobile information or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy.

Your obligations as a client. Where we build or operate messaging automations on your behalf, you remain the sender of record for messages to your own customers. You are responsible for obtaining and retaining valid express written consent from every recipient, for honoring opt-outs promptly, and for complying with the TCPA, CAN-SPAM, and applicable carrier and A2P 10DLC requirements. We will not knowingly send messages to recipients you cannot evidence consent for.

6. Third-Party Integrations

Our services may connect to third-party platforms including QuickBooks Online, GoHighLevel, and others at your direction. Your use of those platforms is subject to their respective terms of service. We are not responsible for the actions, availability, or data practices of third-party services.

7. Intellectual Property

All content, branding, software, and materials on our website are the property of Prolific AI Automation LLC or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components. Your use of our services is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Prolific AI Automation LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages.

10. Indemnification

You agree to indemnify and hold harmless Prolific AI Automation LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of our services or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Michigan.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.
